THE GENERAL ALUMINUM LIMITED WARRANTY

• Single Family Home – Limited Lifetime

General Aluminum warrants solely to the original consumer purchaser (User) of General Aluminum vinyl windows, aluminum windows, vinyl patio doors and aluminum patio doors that the window and door units (excluding multi-family construction and glass) as sold will be free from defects in material and workmanship that significantly impair operation and function for as long as User owns and permanently resides in the home in which these products were first installed. Upon receipt of Notice of a defect in materials or workmanship covered by this Limited Warranty, General Aluminum shall, at its sole option, repair the product, replace defective parts or product or refund the original purchase price for the defective unit.

• Multi-Family Dwelling – Term

General Aluminum warrants solely to the original consumer purchaser (User) of General Aluminum vinyl windows, aluminum windows, vinyl patio doors and aluminum patio doors for use in any structure other than a single-family detached home that the window and door units (excluding glass) will be free from defects in material and workmanship that significantly impair operation and function for a period of one (1) year from certificate of occupancy. Upon receipt of Notice of a defect in materials or workmanship covered by this Limited Warranty, General Aluminum shall provide, at its sole option, a repair of the product, a replacement of defective parts or product or a refund of the original purchase price for the defective unit.

• Glass – Term

General Aluminum warrants to the User that the original insulated glass in General Aluminum windows and doors will be free from failure of the air seal for a period of ten (10) years from the date imprinted on the spacer within the insulated glass unit. Should a material obstruction of vision occur due to failure of the air seal during the ten-year warranty period, General Aluminum, at its sole option, will provide either a replacement piece of insulated glass or a sash glazed with insulated glass.

ANY OBLIGATION OF GENERAL ALUMINUM UNDER THIS WARRANTY IS SUBJECT TO ALL TERMS AND CONDITIONS SET FORTH AND IS CONTINGENT UPON INSTALLATION AND USE CONSISTENT WITH GENERAL ALUMINUM’S INSTALLATION INSTRUCTIONS, PRODUCT SPECIFICATIONS AND PROPER MAINTENANCE.

• Notwithstanding any other term, GENERAL ALUMINUM SHALL BEAR NO RESPONSIBILITY OR LIABILITY WHATSOEVER FOR:

a) glass breakage, distortion or any failure or operating difficulty involving accident, abuse, misuse, alteration, misapplication, faulty building construction or design, failure due to acts of God, lack of product maintenance, handling, storage, or installation, including but not limited to non-vertical, upside down, on-the-side, or out of square installation;

b) any condition resulting from exposure to corrosive fumes or condensation, subjection to stress from movement of the structure, films and coatings on the glass, or use in swimming pool enclosures, natatoriums, or other high humidity areas;

c) CONDENSATION on windows or doors (the result of indoor humidity and relative interior/exterior temperatures), the formation of condensation shall not constitute a product defect;

d) any condition resulting from flooding (any portion of the product being submerged) or extreme wind loads (above and beyond testing requirements)

e) INCIDENTAL OR CONSEQUENTIAL DAMAGES, including but not limited to loss of use and the cost of repairing or replacing property damaged as a result of product defect, failure, misuse, abuse, or any other cause. Some states or provinces do not allow the exclusion or limitation of consequential damages, so the above exclusion or limitation may not apply to you;

f) painting or staining of components; or

g) weathering, product aging or wear and tear.

GENERAL ALUMINUM DOES NOT WARRANT AND HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR OTHER OBLIGATION WITH RESPECT TO ANY CUSTOM UNIT OR ANY COMPONENT THEREOF WHICH IS GREATER IN WIDTH OR HEIGHT THAN THE LARGEST SIZE SHOWN FOR THAT WINDOW MODEL IN ANY PRINTED GENERAL ALUMINUM CATALOG.

• Labor and Shipping Costs

The cost and/or expense of labor associated with the removal or replacement of any window or door product is not included within this Limited Warranty and shall be the sole responsibility of User. The User shall be responsible for shipping, handling, installation and replacement of insulated glass at User’s sole cost and expense.

• Important Notes

- Conformity with all applicable laws, ordinances, building codes and safety requirements is the sole responsibility of the architect, contractor and/or User. General Aluminum neither assumes nor has any responsibilities in this regard.

- This Limited Warranty is not assignable by User.

- General Aluminum reserves the right to discontinue production, or make changes to, any of its products. If products or components covered by this Limited Warranty are not available, General Aluminum will have the right, to furnish, at its sole discretion, a comparable replacement or refund the original purchase price of the affected component.

- Performance under this Limited Warranty shall not create any new or extend any existing warranty obligation.

- General Aluminum reserves the right to charge for on-site inspection.

• This is the entire warranty and no employee or representative of General Aluminum has the authority to change or modify this limited warranty. No other representation or material shall be incorporated herein. There shall be no third-party beneficiary of this warranty.

THIS LIMITED WARRANTY IS EXCLUSIVE, IN LIEU OF, AND EXCLUDES ANY AND ALL OTHER WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE. THIS WARRANTY REPRESENTS A SOLE AND EXCLUSIVE REMEDY. IT IS THE SOLE AND EXCLUSIVE SOURCE OF RESPONSIBILITY OR LIABILITY OF GENERAL ALUMINUM, IRRESPECTIVE OF ITS NEGLIGENCE OR ANY OTHER BASIS OF FAULT. Some states or provinces do not allow limitations of implied warranties, so this limitation may not apply to you. This Limited Warranty gives you specific legal rights and you may also have other rights which vary from state to state or province to province.

• Notice

Notwithstanding any other term, General Aluminum shall have no obligation under its warranty unless effective written notice identifying the claim is received. To be effective, notice of claim must be received prior to expiration of the warranty period and in no event shall a notice given more than one (1) year after first observation of the condition be effective. To be effective, notice must be made in writing to: General Aluminum Customer Service Department, 1001 W. Crosby Road, Carrollton, Texas 75006. Please include with your claim a proof of your original home ownership and proof of original purchase. General Aluminum reserves the right to inspect the product in place and as originally installed.
